Cherry Privacy Policy

This Privacy Policy explains how BENDAQ Ventures LLC (“we,” “us,” or “our”) collects, uses, shares, and protects information when you visit cherrysaidit.com (the “Site”), buy a personalized video message from Cherry, sign up for our newsletter, or join our affiliate program. Together, these are our “Services.”

Cherry is a fictional, AI-generated character. She is not a real person, and messages from Cherry are for entertainment only.

By using the Services, you agree to this Privacy Policy and to our Terms of Service. If you do not agree, please do not use the Services.

1. Who Can Use Cherry

• Purchases. You must be 18 or older to buy a message. You confirm this with a checkbox before checkout.
• Newsletter. You must be 13 or older to sign up. You confirm this when you subscribe.
• Children under 13. The Services are not directed to children under 13. We do not knowingly collect personal information from them. If we learn we have, we delete it promptly. If you believe a child under 13 has given us information, contact us at hello@cherrysaidit.com.

2. Information We Collect

When you buy a message

• About you (the sender): your name and contact information, such as email address or phone number.
• About your recipient: the recipient's name and, if you provide it, their contact information.
• About the order: the occasion you choose, any custom message text, your order number, the date and time of the order, and your purchase type (single message, three-pack or five-pack).
• Age confirmation: a record that you confirmed you are 18 or older and agreed to our Terms and this Policy, with a timestamp.

Payment information

Stripe, our payment processor, handles payments. Stripe collects your card details directly. We never see or store your full card number. We receive limited payment data from Stripe, such as whether the payment succeeded, the amount, and the last four digits of the card. Stripe's use of your information is governed by the Stripe Privacy Policy.

When you join the newsletter

• Your email address.
• A record that you confirmed you are 13 or older, with the date and time you subscribed.
• Basic engagement data, such as whether you open an email or click a link. This helps us see what readers enjoy and keeps our sending healthy.

When you join the affiliate program

• Your name, email address, and the referral link or code we assign you.
• Records of the sales attributed to your referrals and the commissions you earn.
• Payout details. You give these directly to our affiliate platform, Rewardful, in your Rewardful affiliate dashboard, where Rewardful and its payment partners pay you and may verify your identity and collect tax information required by law. We do not collect or store your bank or payout account details.

When you click an affiliate's referral link

If you arrive through a referral link, a cookie records which affiliate referred you. If you then make a purchase, the sale is credited to that affiliate. We see the purchase and the referring affiliate. The affiliate sees that a sale occurred and the commission earned. Affiliates do not see your name, contact information, or message.

When you watch or share a message

When someone opens a Cherry message link, we may record that the video was viewed or downloaded. We may also record whether the “Follow Cherry” button was clicked.

Information collected automatically

Like most websites, our Site and hosting providers collect technical information when you visit. This includes IP address, browser and device type, pages viewed, referring website, and the date and time of your visit. We use this to run, secure, and improve the Site.

Cookies

We use a small number of cookies and similar technologies to:

• Keep the Site working, such as moving you through checkout and keeping you signed in to your Cherry account.
• Track affiliate referrals (see above).
• Understand general Site usage.

You can block or delete cookies in your browser settings. Some features may not work properly if you do, and referral credit may not be assigned.

3. How We Use Your Information

We use your information to:

• Create, personalize, and deliver the messages you order.
• Process payments and send order confirmations.
• Provide customer support and handle re-render requests.
• Send our newsletter, if you subscribed.
• Run our affiliate program, including attributing sales and paying commissions.
• Prevent fraud, abuse, and misuse of the Services. This includes reviewing custom messages and recipient names for offensive or prohibited content.
• Keep records needed to respond to complaints, disputes, or chargebacks.
• Meet legal, tax, and accounting obligations.
• Understand how the Services are used so we can improve them.

4. Cherry, AI, and Your Information

Cherry's videos are made in advance using AI video tools. Your recipient's name is added to the finished video as a text overlay. We do not put your personal information into AI tools to generate messages, and we do not use your personal information to train AI models.

5. How We Share Your Information

We do not sell your personal information. We do not rent or trade it to anyone for their own marketing.

We share information only in these situations:

• Service providers. We share information with trusted companies that help us run the Services and only use it to do work for us. These include:
  • Stripe (payments)
  • Supabase (database and video storage)
  • Vercel (website hosting)
  • Resend (order emails and newsletter delivery)
  • HubSpot (customer relationship management)
  • Rewardful (affiliate tracking and payouts)
  • Google (secure data backups)
  We may change or add providers as our Services grow.
• Your recipient. A message is meant to be shared. Anyone with the link can view the video, including the recipient's name and the sender's name shown with it. Share links only with people you intend to receive them.
• Affiliates. Limited sales and commission information is shared as described in Section 2.
• Legal reasons. We may share information if required by law, subpoena, or court order. We may also share it to protect our rights, investigate fraud or abuse, or protect someone's safety.
• Business transfers. If our business is sold, merged, or reorganized, information may transfer to the new owner under the same protections described here.
• With your consent. In any other case, we share information only with your permission.

6. How Long We Keep Information

We keep information only as long as we need it:

We may keep information longer if needed to resolve a dispute, respond to a legal request, or enforce our Terms.

7. Newsletter and Marketing Emails

• We only send marketing emails if you sign up.
• Every marketing email includes an unsubscribe link and our business mailing address.
• You can unsubscribe at any time. After you do, we may still send emails about orders you place, such as receipts or support replies.

We do not send text messages. If you choose to text a Cherry message link to someone, that text comes from you, not from us.

8. Your Choices and Rights

No matter where you live, you can:

• Access the personal information we hold about you.
• Correct inaccurate information.
• Delete your personal information, subject to records we must keep by law.
• Unsubscribe from marketing emails at any time.
• Leave the affiliate program at any time.

Some states, including California and Oregon, give residents additional privacy rights, such as the right to know what categories of information are collected and to opt out of certain uses. We honor these requests. We do not sell personal information or use it for targeted advertising. We will not treat you differently for exercising any privacy right.

To make a request, email hello@cherrysaidit.com with “Privacy Request” in the subject line. We may need to verify your identity before acting on it. We will respond within the time required by applicable law. You may use an authorized agent to make a request on your behalf, and we may ask for proof of their authorization.

If a recipient wants a message about them removed, they can contact us at the same address.

9. How We Protect Your Information

We use reasonable technical and organizational safeguards to protect your information. These include encrypted connections (HTTPS), access controls, and reputable providers with strong security practices. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you as required by law.

10. Links to Other Sites

The Site links to other sites and platforms, including TikTok, Instagram, and YouTube. Their privacy practices are their own and are not covered by this Policy. Please review their policies before sharing information with them.

11. Where Information Is Stored

We are based in the United States, and your information is stored and processed in the United States. If you use the Services from outside the U.S., you understand your information will be transferred to and processed in the U.S.

12. Changes to This Policy

We may update this Policy from time to time. When we do, we will change the effective date at the top. If the changes are significant, we will give more noticeable notice, such as a notice on the Site or an email to newsletter subscribers. Continuing to use the Services after an update means you accept the revised Policy.
